1. Agreement to these terms
Welcome to lowkey. These Terms of Service (the Terms) are a legal agreement between you and DYM LABS LLC (also referred to as lowkey, we, us, or our) and govern your access to and use of the lowkey mobile apps, the lwk.bio website, and related services (together, the Service). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use lowkey only with the involvement of a parent or legal guardian. By using the Service you confirm that you meet these requirements.
3. Your account
To use most features you create an account with a username, and optionally an email address to help secure and recover it. You are responsible for the activity on your account and for keeping your login safe. Let us know at hello@lwk.bio if you believe your account has been compromised.
4. How lowkey works
lowkey lets people send and receive anonymous badges. You can share your lowkey link, receive badges from others, and collect them on your profile. Badges are sent anonymously by design, as described in our Privacy Policy.
5. Acceptable use
Anonymity is part of the fun, but it is not a shield for abuse. You agree not to use the Service to:
- harass, bully, threaten, or intimidate anyone;
- post hateful, violent, sexually explicit, or otherwise objectionable content;
- attempt to identify, dox, or de-anonymize other users;
- impersonate any person or entity;
- send spam, scams, or unsolicited promotions;
- infringe the rights of others; or
- break any applicable law.
We may remove content and suspend or terminate accounts that violate these rules.
6. Your content and license
You keep ownership of the content you create or send (your Content). By submitting Content, you grant lowkey a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that Content as needed to operate, improve, and provide the Service. This license ends when your Content or your account is deleted, except for copies retained as required by law or kept in routine backups for a limited time.
7. Reporting and moderation
You can report badges or accounts that break these rules from within the app or by emailing hello@lwk.bio. We review reports and may act on them, but we do not pre-screen all Content and are not responsible for Content created by users.
8. lowkey Pro and payments
Some features are offered through lowkey Pro, a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play under their terms. Subscriptions renew automatically for the same period and at the then current price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your App Store or Google Play account settings. Except where required by law or by the applicable app store, payments are non-refundable, and refund requests are handled by Apple or Google.
9. Intellectual property
The Service, including the lowkey name, logo, design, and software, is owned by DYM LABS LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works from the Service except as allowed by law.
10. Third party services
The Service relies on third parties such as Apple, Google, payment processors, and hosting providers. Your use of those services may be subject to their own terms, and we are not responsible for third party services.
11. Disclaimers
The Service is provided on an as is and as available basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error free, or that any Content is accurate or reliable.
12. Limitation of liability
To the fullest extent permitted by law, DYM LABS LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.
13. Indemnification
You agree to indemnify and hold harmless DYM LABS LLC from any claims, damages, or expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal, security, or operational reasons. Provisions that by their nature should survive termination will survive.
15. Changes to the Service and these terms
We may update the Service and these Terms as lowkey grows. If we make material changes to the Terms, we will provide notice in the app or by other reasonable means and update the date above. Your continued use of the Service after the changes take effect means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which DYM LABS LLC is organized, without regard to conflict of law rules. You agree that any dispute will be resolved in the courts located there, unless applicable law gives you the right to bring a claim elsewhere.
